The rules governing your use of Domanda and your rights as a user.
1. Who we are
Domanda is a trading name operated by Lorenzo Darsie, a sole proprietorship (eenmanszaak) registered in the Netherlands.

2. Acceptance and eligibility
By creating an account or using the Domanda platform, you agree to these Terms and Conditions in full. If you do not agree, do not use the service.
You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement. We do not knowingly provide services to persons under 18.
These terms are available in English only. English is the controlling language in all matters.
3. The service
Domanda provides an AI-powered platform for creating and running conversational interviews. Account holders (referred to as "you" or "the researcher") can create interview configurations, share them with respondents, and access the resulting conversation data and analysis.
We do not guarantee that the service will be available at all times. No uptime commitment or service level agreement is provided.
4. Account responsibility
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately via the contact form if you suspect unauthorised access.
You are responsible for the interview configurations you create, the content of your prompts, and the manner in which you share your interviews with respondents.
5. Subscriptions and billing
Plans and payment
Domanda offers paid subscription plans. Prices are displayed on the pricing page and are inclusive of 21% Dutch VAT (BTW) where applicable. Payment is processed by Mollie B.V.
Auto-renewal
Paid subscriptions renew automatically at the end of each billing period. You can cancel at any time from the billing section of your dashboard; cancellation takes effect at the end of the current paid period, and you retain full access until then.
Payment failure
If a payment fails, you will receive an email notification. The credits associated with the failed renewal period will not be granted. Your account will remain active but may be limited until the payment issue is resolved.
Refunds
You may request a refund within 14 days of payment if you have not used the service during that period, or if a technical failure on our part has prevented you from using it. To request a refund, use our contact form. Refunds are not available for pay-as-you-go credit purchases once credits have been granted, except in cases of technical failure.
Price changes
We will notify you by email at least 14 days before any price increase takes effect. Continued use of the service after a price change constitutes acceptance of the new price.
6. Credits
Credits are consumed when you use AI-powered features of the platform. Subscription credits are granted at the start of each billing period. Unused subscription credits roll over for up to 2 months; credits older than 2 months expire automatically.
Pay-as-you-go credits do not expire. Credits are non-transferable and non-refundable, except in cases of technical failure as described in section 5.
7. Invoices
An invoice is generated for each successful payment if you have requested one by selecting the invoice option during checkout. Invoices are sent to your registered email address and are also available for download from your billing dashboard.
8. Acceptable use
You may use Domanda only for lawful purposes and in accordance with these terms. The following uses are prohibited:
- Collecting data from minors without the explicit consent of a parent or legal guardian.
- Any data collection that violates applicable law, including but not limited to GDPR and the Dutch Wet bescherming persoonsgegevens.
- Running interviews for unsolicited outreach or spam campaigns.
- Using the platform to collect competitive intelligence through scraping or deceptive means.
- Creating interview configurations that contain harmful, illegal, defamatory, or abusive content.
- Attempting to circumvent access controls, rate limits, or security measures.
You are responsible for ensuring that you have a valid legal basis and appropriate transparency notice for any personal data you collect from respondents through your interview configurations.
9. Intellectual property
The Domanda platform, including its design, code, and branding, is owned by Lorenzo Darsie. All rights are reserved.
You retain ownership of the interview configurations and prompts you create. You grant Domanda a limited licence to store and process this content solely to provide the service to you.
Respondent conversation content belongs to the respondent. As the data controller for that content, you are responsible for handling it in accordance with applicable data protection law.
10. Data processing agreement
This section constitutes the Data Processing Agreement (DPA) between you (as data controller) and Domanda (as data processor) for respondent data collected through your interview configurations, as required by GDPR Art. 28.
Subject matter and duration
Domanda processes respondent conversation data on your behalf for the duration of your account and for as long as the data is retained under the privacy settings you configure. Processing ends when you delete the data or close your account.
Nature and purpose of processing
Domanda stores conversation messages, generates AI-powered analysis, and presents results to you through the dashboard. Processing is strictly limited to providing the service as described.
Type of personal data
Open-text interview responses, session identifiers, and any other personal data that respondents voluntarily share during the interview. The type and sensitivity of data depends entirely on the questions you configure.
Categories of data subjects
Your interview respondents, as defined and recruited by you.
Your obligations as controller
By accepting these terms you confirm that:
- You have a valid legal basis under GDPR Art. 6 for collecting respondent data through your interviews.
- You have provided respondents with a privacy notice before they participate (Domanda shows a mandatory privacy text at the start of each interview, which you are responsible for drafting accurately in the configuration settings).
- You will handle respondents' GDPR rights requests (access, erasure, portability, restriction) in your capacity as controller.
- You will not configure interviews that collect special category data (Art. 9) without ensuring the additional conditions for processing such data are met.
Domanda's obligations as processor
Domanda will:
- Process respondent data only on your documented instructions and for no other purpose.
- Implement the technical and organisational security measures described in our Privacy Policy.
- Assist you in fulfilling your obligations to respond to respondents' rights requests, including by providing deletion tools and data exports in the dashboard.
- Notify you without undue delay if we become aware of a personal data breach affecting your respondent data.
- Delete or return all respondent data upon termination of the service relationship, as technically possible.
- Not engage additional sub-processors beyond those listed below without informing you in advance.

Domanda uses the following sub-processor to deliver the service:

We will inform you of any intended changes to this list with reasonable advance notice, giving you the opportunity to object.
11. Content moderation and enforcement
We reserve the right to review, remove, or disable any interview configuration that we reasonably believe violates these terms or applicable law. We may do so without prior notice.
We reserve the right to suspend or permanently terminate accounts that violate these terms. In serious cases, we may take legal action. You may close your account at any time from the account settings page.
12. Availability and liability
The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability or that the service will be error-free.
To the maximum extent permitted by applicable law, Domanda is not liable for any indirect, incidental, consequential, or special damages arising from your use of or inability to use the service, including but not limited to loss of data, loss of profits, or business interruption.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Dutch law.
13. Force majeure
We are not liable for any failure or delay in providing the service caused by circumstances beyond our reasonable control, including outages or failures of third-party infrastructure providers (such as hosting or payment services), natural disasters, or changes in law.
14. Consumer rights
If you are a consumer (a natural person acting outside the scope of a trade, business, or profession), Dutch and EU consumer protection law may grant you additional rights that these terms cannot exclude, including:
- Right of withdrawal: Under EU Directive 2011/83, you have the right to withdraw from a distance contract within 14 days without giving a reason. However, this right does not apply once you have started using the service before the 14-day period has elapsed, provided you gave your explicit prior consent and acknowledged that the right of withdrawal would be lost. By starting to use the service after subscribing, you confirm this consent.
- Dispute resolution: Dutch consumer law provides additional protections that apply regardless of any contractual limitations set out in these terms.
15. Governing law and disputes
These terms are governed by the laws of the Netherlands. In the event of a dispute, we encourage you to contact us first via the contact form so we can attempt to resolve the matter amicably.
If we cannot resolve the matter within 30 days, either party may refer the dispute to mediation before initiating court proceedings. If mediation fails or is declined, disputes will be submitted to the competent court in the Netherlands. For consumers, this does not affect your right to bring proceedings in the courts of your country of residence where required by applicable law.
16. Changes to these terms
We may update these terms from time to time. We will notify registered account holders by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
